BILL ANALYSIS Appropriations Committee Fiscal Summary 25 (Migden) Hearing Date: 9/6/01 Amended: 8/20/01 Consultant: Karen French Policy Vote: Judiciary 4-2 ____________________________________________________________ ___ BILL SUMMARY: AB 25 expands the class of persons who may establish and register a domestic partnership and expands the legal rights and economic benefits of domestic partners. The specific provisions which would result in fiscal impact are as follows: Allows opposite sex couples to register as long as one individual is at least 62 years of age and enrolled in Medicare. Exempts domestic partners dependent health coverage from state taxation; Extends eligibility for unemployment benefits to a domestic partner who moves to a new location. Provides that a domestic partner who receives a retirement allowance as the surviving beneficiary also is entitiled to continued health coverage as are the children of such persons. AB 26 (Migden) of 1999 statutorily recognized domestic partnerships in the state of Califonria and provided the manner by which such partnerships may be formed, registered and terminated. AB 26 gave limited legal effect of such partnerships and provided no rights other than to allow hospital visitation and to provide for health benefits partners of public employees.
