BILL ANALYSIS AB 1857 Page 1 Date of Hearing: April 24, 2002 ASSEMBLY COMMITTEE ON APPROPRIATIONS Darrell Steinberg, Chair AB 1857 (Wayne) - As Amended: March 19, 2002 Policy Committee: Business and Professions Vote: 12-0 (Consent) Urgency: No State Mandated Local Program: No Reimbursable: SUMMARY This bill clarifies and refines the state's administrative rulemaking procedures based on recommendations of the California Law Review Commission. Specifically, this bill: 1)Requires a state agency maintaining an Internet Web site to include the text of a proposed emergency rulemaking action and the date the proposal was submitted to the Office of Administrative Law. 2)Requires rulemaking documents to be posted on an agency's Web site for at least 15 days after the rulemaking process ends. 3)Requires an agency, in its statement of reasons for proposing a regulation, to describe its reasons for rejecting any reasonable alternatives. 4)Makes other technical and clarifying changes. FISCAL EFFECT Minor absorbable General Fund and special fund costs for agencies to comply with the bill's requirements. COMMENTS Purpose . This bill is sponsored by the California Law Review Commission (CLRC), which indicates that the bill is the product of its February 2002 recommendations regarding administrative rulemaking refinements.
