BILL ANALYSIS SB 563 Page 1 Date of Hearing: July 11, 2001 ASSEMBLY COMMITTEE ON APPROPRIATIONS Carole Migden, Chairwoman SB 563 (Morrow) - As Amended: May 1, 2001 Policy Committee: Public SafetyVote: 7-0 Urgency: No State Mandated Local Program: No Reimbursable: SUMMARY This bill makes the following changes recommended by the California Law Revision Commission to the emergency rulemaking authority of the California Department of Corrections (CDC): 1)Defines "pilot program" and specifies that the procedures for adopting a pilot program regulation and emergency regulations also apply to the amendment or repeal of such regulations. 2)Extends the period for Office of Administrative Law review of an emergency regulation justified by the CDC on the basis of operational needs, rather than on the basis of an emergency. FISCAL EFFECT Negligible. COMMENTS Rationale . The California Law Revision Commission is required to study topics approved for its study by concurrent resolution of the Legislature. ACR 17 (Wayne, Statutes of 1999) included the topic of changes to administrative law and recommended in October 2000 the minor changes to CDC rulemaking provisions that are contained in this legislation.
