LEGISLATIVE COUNSEL'S DIGEST SB 544, Committee on Local Government. Local agency officials: eligibility. Existing law prohibits an employee of a local agency from being sworn into office as an elected or appointed member of the legislative body of that local agency unless he or she resigns as an employee. Existing law excludes a county from the definition of local agency for the purposes of this prohibition and does not include the board of supervisors of a county in the definition of legislative body. This bill would define local agency for purposes of this prohibition to include a county and would define legislative body to include a county board of supervisors. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 53227.2 of the Government Code is amended to read: 53227.2. For purposes of this article, the following definitions apply: (a) "Local agency" means a city, city and county, county, district, municipal or public corporation, political subdivision, or other public agency of the state. (b) "Legislative body" means the board of supervisors of a county or a city and county, the city council of a city, or the governing body of a district, municipal or public corporation, political subdivision, or other public agency of the state.
