BILL NUMBER: AB 2402 CHAPTERED 07/15/02 CHAPTER 186 FILED WITH SECRETARY OF STATE JULY 15, 2002 APPROVED BY GOVERNOR JULY 13, 2002 PASSED THE SENATE JUNE 28, 2002 PASSED THE ASSEMBLY MAY 9, 2002 AMENDED IN ASSEMBLY MAY 7, 2002 INTRODUCED BY Assembly Member Rod Pacheco FEBRUARY 21, 2002 An act to add Section 22353 to the Vehicle Code, relating to speed limits. LEGISLATIVE COUNSEL'S DIGEST AB 2402, Rod Pacheco. Speed limits: City of Norco: pedestrian and equestrian trails. Existing law prohibits any person from driving a vehicle at a speed greater than the speed limit. Existing law generally sets forth prima facie speed limits unless changed or otherwise authorized by law. Existing law permits local authorities to set prima facie speed limits higher or lower than the established prima facie speed limits on the basis of an engineering and traffic survey, as defined, if the different speed limit is necessary to facilitate the orderly movement of traffic and is reasonable and safe. This bill would authorize the City of Norco, when conducting an engineering and traffic survey, to consider equestrian safety in addition to the specified factors set forth. The bill would make legislative findings and declarations as to the necessity of a special statute. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 22353 is added to the Vehicle Code, to read: 22353. When conducting an engineering and traffic survey, the City of Norco, in addition to the factors set forth in Section 627, may also consider equestrian safety. SEC. 2. The Legislature finds and declares that, because of the unique circumstances applicable only to the City of Norco and the equestrian trails there, a statute of general applicability cannot be enacted within the meaning of subdivision (b) of Section 16 of Article IV of the California Constitution. Therefore, this special statute is necessary.
