BILL NUMBER: SB 85 CHAPTERED 09/04/01 CHAPTER 233 FILED WITH SECRETARY OF STATE SEPTEMBER 4, 2001 APPROVED BY GOVERNOR SEPTEMBER 1, 2001 PASSED THE ASSEMBLY AUGUST 20, 2001 PASSED THE SENATE MAY 10, 2001 AMENDED IN SENATE MAY 8, 2001 AMENDED IN SENATE MARCH 27, 2001 INTRODUCED BY Senator Murray JANUARY 11, 2001 An act to amend Section 1812.84 of the Civil Code, relating to contracts. LEGISLATIVE COUNSEL'S DIGEST SB 85, Murray. Contracts: health studios. Existing law regulates contracts for health studio services, defined to include contracts for instruction, training, or assistance in exercising, body building, and any other such physical skills. The law provides that the length of the term of these contracts may not exceed 3 years, nor may they require payments or financing over a period of more than 3 years. This bill would prohibit a contract for health studio services from requiring payments or financing that exceed the term of the contract. This bill would also require a contract for health studio services to make specified disclosures about the length of the term of the contract. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 1812.84 of the Civil Code is amended to read: 1812.84. (a) A contract for health studio services may not require payments or financing by the buyer to exceed the term of the contract, nor may the term of the contract exceed three years. (b) A contract for health studio services shall include a statement printed in a size at least 14-point type that discloses the length of the term of the contract. This statement shall be placed above the space reserved for the signature of the buyer.
