LEGISLATIVE COUNSEL'S DIGEST SB 433, Machado. Air resources: civil and administrative penalties. (1) Existing law, as of January 1, 2003, makes a person who transports, or who provides a vehicle to transport, motor vehicle fuel for a motor vehicle fuel distributor who is not in compliance with specified laws, liable for a civil penalty. This bill would repeal that law. (2) Existing law, which is to be repealed on January 1, 2003, provides for civil or administrative penalties up to a prescribed maximum, depending on the nature of the violation, for a violation of prescribed statutes or any rule, regulation, permit, variance, or order of the State Air Resources Board pertaining to fuel requirements and standards. The recovery of those penalties precludes criminal prosecution, or the filing of a criminal complaint requires dismissal of any action or administrative proceeding seeking those civil penalties. This bill would repeal that repeal date, thereby extending the operation of those provisions indefinitely. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 43021 of the Health and Safety Code is repealed. SEC. 2. Section 43033 of the Health and Safety Code is repealed.
