LEGISLATIVE COUNSEL'S DIGEST AB 933, Migden. State employees: compensation. The annual Budget Act appropriates specified amounts from the General Fund, unallocated special funds, and unallocated nongovernmental cost funds for state employee compensation. This bill would appropriate $69,515,000 from those funds for state employee compensation, in augmentation of the Budget Act of 2001. This bill would declare that it is to take effect immediately as a statute providing an appropriation for the usual and current expenses of the state. Appropriation: yes. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. The appropriations made by this act are in augmentation of the appropriations made in Section 2.00 of the Budget Act of 2001 (Ch. 106, Stats. 2001) and are subject to the provisions of that act, as appropriate, including, as applicable, the provisions of that act that apply to the items of appropriation that are augmented by this act. SEC. 2. Item 9800-001-0001 is added to Section 2.00 of the Budget Act of 2001 (Chapter 106 of the Statutes of 2001), to read: 9800-001-0001--For augmentation for state employee compensation ................................... 45,517,000 Provisions: 1. The amount appropriated in this item shall not be construed to control or influence collective bargaining between the state employer and employee representatives. 2. The funds appropriated in this item are for employee compensation increases and increases in benefits related thereto, whose compensa- tion, or portion thereof, is chargeable to the General Fund, to be allocated by executive order by the Department of Finance to the several state offices, departments, boards, bureaus, commissions, and other state agencies, in augmentation of their respective appropria- tions or allocations for support, in accordance with approved memoranda of understanding or, for employees excluded from collective bargaining, in accordance with salary and benefit schedules established by the Depart- ment of Personnel Administration. SEC. 3. Item 9800-001-0494 is added to Section 2.00 of the Budget Act of 2001 (Chapter 106 of the Statutes of 2001), to read: 9800-001-0494--For augmentation for state employee compensation, payable from other unallocated special funds .................................. 15,359,000 Provisions: 1. The amount appropriated in this item shall not be construed to control or influence collective bargaining between the state employer and employee representatives. 2. The funds appropriated in this item are for employee compensation increases and increases in benefits related thereto, whose compensa- tion, or portion thereof, is chargeable to special funds, to be allocated by executive order by the Department of Finance to the several state offices, departments, boards, bureaus, commissions, and other state agencies, in augmentation of their respective appropriations or allocations, in accordance with approved memoranda of understanding or, for employees excluded from collective bargaining, in accordance with salary and benefit schedules established by the Department of Personnel Administration. The amount appropriated in this item shall not be construed to control or influence collective bargaining between the state employer and employee representatives. 2. The funds appropriated in this item are for employee compensation increases and increases in benefits related thereto, whose compensa- tion or portion thereof, is chargeable to nongovernmental cost funds, to be allocated by executive order by the Department of Finance to the several state offices, departments, boards, bureaus, commissions, and other state agencies, in augmentation of their respective appropriations or allocations for support, in accordance with approved memoranda of understanding or, for employees excluded from collective bargaining, in accordance with salary and benefit schedules established by the Department of Personnel Administration. SEC. 5. This act makes an appropriation for the usual and current expenses of the state within the meaning of Article IV of the California Constitution and shall go into immediate effect.
