LEGISLATIVE COUNSEL'S DIGEST AB 966, Wesson. Baldwin Hills Conservancy: Kenneth Hahn State Recreation Area. Under existing law, the Baldwin Hills Conservancy is authorized to acquire and manage public lands within the Baldwin Hills area, which is defined to include land within the Kenneth Hahn State Recreation Area. The Budget Act of 2001 appropriated $4,000,000 to the Department of Parks and Recreation for capital outlay projects within the Kenneth Hahn State Recreation Area. Chapter 400 of the Statutes of 2001 reappropriated the unencumbered balance of that sum for the acquisition, development, and planning of that project. This bill would reappropriate to the department the unencumbered balance of the funds appropriated pursuant to those provisions for the acquisition, planning, preliminary plans, working drawings, equipment, and construction of the project specified in that schedule, and would make the funds available for expenditure in the 2002-03, 2003-04, and 2004-05 fiscal years. The bill would declare that it is to take effect immediately as an urgency statute. Appropriation: yes. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. The remainder of any unencumbered funds appropriated to the Department of Parks and Recreation pursuant to Schedule (7) of Item 3790-302-0005 of Section 2.00 of the Budget Act of 2001 (Ch. 106, Stats. 2001), and reappropriated pursuant to Section 11 of Chapter 400 of the Statutes of 2001, is hereby reappropriated to the department for the acquisition, planning, preliminary plans, working drawings, equipment, and construction, including, but not limited to, trail development and improvement and habitat restoration, of the project specified in that schedule, and shall be available for expenditure in the 2002-03, 2003-04, and 2004-05 fiscal years. SEC. 2. This act is an urgency statute necessary for the immediate preservation of the public peace, health, or safety within the meaning of Article IV of the Constitution and shall go into immediate effect. The facts constituting the necessity are: In order to reappropriate certain funds to the Department of Parks and Recreation for a project in the Kenneth Hahn Recreation Area at the earliest possible time, it is necessary that this act take effect immediately.
