LEGISLATIVE COUNSEL'S DIGEST AB 42, Negrete McLeod. Public Employees' Retirement System. Existing law establishes the Board of Administration of the Public Employees' Retirement System and the composition of its membership. This bill would authorize a specified member of the board to designate a deputy to act in the member's absence, as specified. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 20090.1 is added to the Government Code, to read: 20090.1. Notwithstanding any other provision of law to the contrary, the member of the board who is an elected official of a contracting agency appointed by the Governor, pursuant to subdivision (e) of Section 20090, may designate a deputy, who is employed under the official's authority, to act in his or her place and stead on the board or any of its committees. The deputy, while sitting on the board or any of its committees, may exercise the same powers that the elected official could exercise if he or she were personally present. The board member shall be responsible for the acts of the deputy acting under this designation.
