LEGISLATIVE COUNSEL'S DIGEST SB 1415, Perata. San Francisco Bay Area Rapid Transit District. Existing law authorizes the San Francisco Bay Area Rapid Transit District to acquire, construct, own, operate, control, or use rights-of-way, rail lines, bus lines, stations, platforms, switches, yards, terminals, parking lots, and any and all other facilities necessary or convenient for rapid transit service within or partly without the district, as specified. The existing California Environmental Quality Act (CEQA) requires a lead agency, as defined, to prepare, or cause to be prepared, and certify the completion of, an environmental impact report on a project that it proposes to carry out or approve that may have a significant effect on the environment, or to adopt a negative declaration if it finds that the project will not have that effect. The act exempts from the requirement specified discretionary projects, including specific actions necessary to prevent or mitigate an emergency. The bill would include in those exempt actions, until June 30, 2005, the San Francisco Bay Area Rapid Transit District's seismic retrofit work on any existing structures or facilities, as specified, necessary for rapid transit service if the district conducts 3 workshops and other outreach efforts to ensure public awareness of the proposed seismic retrofit work prior to commencement of construction. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 29031.1 is added to the Public Utilities Code, to read: 29031.1. (a) If the district conducts three workshops and other outreach efforts to ensure public awareness of the proposed seismic retrofit work prior to commencement of construction, the district's seismic retrofit work on any existing structures or facilities contained in the San Francisco Bay Area Rapid Transit District Seismic Retrofit Program Phase I-Segment I necessary for rapid transit service shall be considered to be an action necessary to prevent or mitigate an emergency, for the purposes of paragraph (4) of subdivision (b) of Section 21080 of the Public Resources Code. (b) This section shall become inoperative on June 30, 2005, and, as of January 1, 2006, is repealed, unless a later enacted statute, that becomes operative on or before January 1, 2006, deletes or extends the dates on which it becomes inoperative and is repealed.
