An act to add Section 1724 to the Civil Code, relating to retail
sales.

AB 258, as introduced, Calderon. Retail sales: personal
information.
Existing law prohibits, with certain exceptions, any person
accepting a negotiable instrument as payment for goods or services
sold or leased at retail from, among other things, requiring as a
condition of acceptance that the person paying with the negotiable
instrument provide a credit card as means of identification and from
recording the credit card number.
This bill would prohibit any retail seller from requesting
personal identifying information, as defined, from any person making
a return or exchange of merchandise, if paid for by cash.
Vote: majority. Appropriation: no. Fiscal committee: no.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:
SECTION 1. Section 1724 is added to the Civil Code, to read:
1724. For the purpose of returning or exchanging merchandise paid
for by cash, no retail seller may request personal identifying
information, as defined by subdivision (c) of Section 1798.92, from
any person making that return or exchange. A receipt for the return
or exchange of this merchandise shall be sufficient identification.
