BILL SUMMARY: AB 471 would (1) prohibit, as of January 1,
2005, a cruise ship, as defined, from conducting onboard
incineration while operating within three miles of the
California coast; (2) make definitions; and (3) require the
Air Resources Board (ARB) to enforce this chapter and
authorize it to adopt standards, rules, and regulations.

Costs to ARB for rulemaking and regulations would be about
$100,000. Enforcement costs are unknown, but could result
in the need for an additional position.

AB 2746 (Nakano) Chapter 504, Statutes of 2000, enacted the
Large Passenger Vessels Law. AB 121 (Simitian) Chapter
488, Statutes of 2003, prohibits owners or operators of
large passenger vessels from releasing sewage sludge and
oily bilgewater into state marine waters and marine
sanctuaries, as specified. AB 433 (Nation) Chapter 491,
Statutes of 2003, changes the Ballast Water Management for
Control of Nonindigenous Species Law to the Marine Invasive
Species Act, and revises various requirements for ballast
water management practices to minimize release of
nonindigenous species. AB 906 (Nakano) Chapter 494,
Statutes of 2003, prohibits the release of hazardous waste
and "other waste" from large passenger vessels into state
marine waters and marine sanctuaries under certain
conditions. AB 2093 (Nakano) prohibits a large passenger
vessel owner or operator from releasing graywater into
state marine waters. AB 2672 (Simitian) prohibit the
release of sewage within three miles of the coast if the
SWRCB has the authority to prohibit such a release; and
would require the owner or operator of a large passenger
vessel that releases sewage into the marine waters of the
state or a marine sanctuary to immediately report the
release to SWRCB. AB 2672 was heard in this committee
August 4, 2004 and failed passage. Reconsideration was
granted.
