SUMMARY : Prohibits a cruise ship from conducting onboard
incineration while operating within three miles of the
California coast.
The Senate amendments are consistent with the Assembly version
of this bill, but substantially reduce the scope of this bill.
They reduce the prohibition of onboard incineration from within
90 miles down to three miles off of the California coast.
Eliminate the requirement of cruise ships to use only California
diesel fuel while operating within 25 miles of the California
coast.
AS PASSED BY THE ASSEMBLY , this bill placed more expansive
restrictions on cruise ships in order to reduce air pollution
by: 1) prohibiting cruise ships from conducting onboard waste
incineration while operating within 90 miles of the California
coast as of January 1, 2004; and,
2) requiring cruise ships operating within 25 miles of the
California coast to use only California diesel fuel as of
January 1, 2005.
FISCAL EFFECT : According to the Senate Appropriations
Committee, costs to the Air Resources Board for rulemaking and
regulations would be about $100,000. Enforcement costs are
unknown, but could result in the need for an additional
position.
COMMENTS : Cruise ships are equipped with incinerators and
boilers that burn a variety of wastes including: hazardous
wastes, oil, oily sludge, sewage, medical and bio-hazardous
waste, outdated pharmaceuticals, and other solid wastes such as
plastics, paper, metal, glass, and food. The emissions from
onboard incineration include dioxins, nitrogen oxide, sulfur

oxide, carbon monoxide, carbon dioxide, particulate matter,
hydrogen chloride, hydrocarbons, and toxic metals such as lead,
cadmium, and mercury. The author's office states that this bill
will provide greater protection of California's coastal
environment and air quality by regulating certain cruise ship
practices in port and close to shore.
