BILL NUMBER: AB 2518 CHAPTERED 07/06/04 CHAPTER 109 FILED WITH SECRETARY OF STATE JULY 6, 2004 APPROVED BY GOVERNOR JULY 5, 2004 PASSED THE SENATE JUNE 24, 2004 PASSED THE ASSEMBLY APRIL 22, 2004 AMENDED IN ASSEMBLY APRIL 16, 2004 INTRODUCED BY Assembly Member Keene FEBRUARY 20, 2004 An act to add Section 5080.29 to the Public Resources Code, relating to state parks. LEGISLATIVE COUNSEL'S DIGEST AB 2518, Keene. State parks: concession contracts. Existing law authorizes the Department of Parks and Recreation to enter into contracts for the construction, maintenance, and operation of concessions within units of the state park system for the safety and convenience of the general public in the use and enjoyment of, and the enhancement of recreational and educational experiences at, units of the state park system. Existing law provides that the maximum term of those concession contracts is 10 years, or up to 20 years, if the Director of Parks and Recreation makes specified determinations. Existing law prohibits the term of a concession contract from exceeding 20 years without specific authorization by statute. This bill would authorize the department to enter into concession contracts for the development, operation, and maintenance of marinas, for a term of up to 30 years, if the director determines that this longer term is necessary to allow for amortization of the loan, or to serve the best interests of the state. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 5080.29 is added to the Public Resources Code, to read: 5080.29. Notwithstanding any other provision of law, including subdivision (a) of Section 5080.18, the department may enter into concession contracts for the development, operation, and maintenance of marinas, for a term of up to 30 years, if the director determines that the term authorized under this section is necessary to allow for amortization of the loan, or to serve the best interests of the state.
