LEGISLATIVE COUNSEL'S DIGEST AB 2018, Chu. Domestic violence: civil damages. Existing law generally provides that all property acquired by a married person during the marriage while domiciled in this state is community property. Upon dissolution of marriage or legal separation of the parties to a marriage, the court is directed to divide the community property estate pursuant to specified provisions. This bill would provide, in any proceeding for dissolution of marriage, if there is a judgment for civil damages for an act of domestic violence perpetrated by one spouse against the other spouse, the court may enforce that judgment against the abusive spouse's share of community property, as specified. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 2603.5 is added to the Family Code, to read: 2603.5. The court may, if there is a judgment for civil damages for an act of domestic violence perpetrated by one spouse against the other spouse, enforce that judgment against the abusive spouse's share of community property, if a proceeding for dissolution of marriage or legal separation of the parties is pending prior to the entry of final judgment.
