LEGISLATIVE COUNSEL'S DIGEST SB 690, Ashburn. Horse racing. Existing law authorizes the Horse Racing Board to permit fairs to operate satellite wagering facilities at their fairgrounds, under certain conditions. In addition, existing law permits any fair in San Joaquin, Humboldt, Fresno, or Shasta County, with the approval of the Department of Food and Agriculture and the authorization of the board, to operate one satellite wagering facility within the boundaries of the fair, as specified. Existing law permits any fair in Kern County to operate a satellite wagering facility at its fairgrounds under specified circumstances. This bill would permit any fair in Kern County, with the approval of the Department of Food and Agriculture and the authorization of the board, to operate one satellite wagering facility within the boundaries of the fair, on the same conditions as apply in Shasta County. Under existing law, all revenue distributed to the state as license fees from satellite wagering facilities is required to be deposited in the Fair and Exposition Fund and is continuously appropriated to the Department of Food and Agriculture for various regulatory and general governmental purposes. By authorizing a satellite wagering facility within the boundaries of any fair in Kern County, this bill would provide for the additional payment of license fees by the satellite wagering facility for deposit in the fund, thereby making an appropriation, and authorizing the imposition of a state tax for purposes of Article XIII A of the California Constitution. Appropriation: yes. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 19605.52 of the Business and Professions Code is amended to read: 19605.52. Notwithstanding subdivision (a) of Section 19605, and Section 19605.1, any fair in Kern or Shasta County may, with the approval of the Department of Food and Agriculture and the authorization of the board, subject to the conditions specified in Section 19605.3, operate one satellite wagering facility within the boundaries of that fair.
