LEGISLATIVE COUNSEL'S DIGEST AB 2140, Runner. Desert species: fines. (1) Existing law establishes the California Desert Native Plants Act, which endeavors to protect California desert native plants from unlawful harvesting on both public and privately owned lands. Existing law makes any person who violates the act guilty of a misdemeanor punishable by a fine of not less than $300, nor more than $1,000, for each violation or by imprisonment in the county jail not to exceed one year, or both, and makes each violation a separate offense. Existing law requires the department to enforce the provisions of the act. This bill would increase the amount of that fine to not less than $1,500, and not more than $2,500, for each violation. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 80172 of the Food and Agricultural Code is amended to read: 80172. A person violating any provision of this division is guilty of a misdemeanor punishable by a fine of not less than one thousand five hundred dollars ($1,500), nor more than two thousand five hundred dollars ($2,500), for each violation or by imprisonment in the county jail not to exceed one year, or both, and each violation constitutes a separate offense.
