LEGISLATIVE COUNSEL'S DIGEST AB 3024, Committee on Agriculture. Seed law. Existing law, the California Seed Law, generally regulates the sale and production of seeds in this state. Existing law requires that the Secretary of Food and Agriculture and the commissioner of each county enforce the provisions and requirements of the California Seed Law. This bill would instead require the secretary, and, under the supervision and direction of the secretary, the commissioner of each county and the qualified representative of the commissioner, to enforce the provisions of the California Seed Law. The bill would give the secretary the discretion to determine which enforcement activities shall be conducted by the commissioner in each county and which enforcement activities shall be conducted by department personnel. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 52282 of the Food and Agricultural Code is amended to read: 52282. The secretary and, under the supervision and direction of the secretary, the commissioner of each county and the qualified representative of the commissioner, shall enforce this chapter and carry out its provisions and requirements. The secretary shall have the discretion to determine which enforcement activities are conducted by the commissioner in each county and which enforcement activities shall be conducted by department personnel.
