LEGISLATIVE COUNSEL'S DIGEST SB 607, Aanestad. Beverage container recycling. The California Beverage Container Recycling and Litter Reduction Act defines "convenience zone," for purposes of providing recycling centers under the act, as an area within a1/2 mile radius of a supermarket or, alternatively, as a zone designated by the Department of Conservation in an underserved area with no supermarket. This bill would revise that definition of "convenience zone" to delete the alternative designation of a convenience zone. The bill, instead, would provide that in a rural region, as specified, the Department of Conservation may, upon petition of an interested person, increase a convenience zone that is otherwise not being served by a certified recycling center or location or is exempted by the department, to include the area within a 3-mile radius of a supermarket, if the expanded convenience zone would then be served by a certified recycling center or location. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 14509.4 of the Public Resources Code is amended to read: 14509.4. "Convenience zone" means all of the following: (a) The area within a one-half mile radius of a supermarket. (b) (1) Notwithstanding subdivision (a), in a rural region, as identified pursuant to subparagraph (A) of paragraph (2) of subdivision (b) of Section 14571, the department may, upon petition by an interested person, increase a convenience zone that meets the requirements of paragraph (2) to include the area within a three-mile radius of a supermarket, if the expanded convenience zone would then be served by a certified recycling center or location. (2) Paragraph (1) applies only to a convenience zone that is otherwise not being served by a certified recycling center or location meeting the requirements of Section 14571 or is exempted by the department pursuant to Section 14571.8.
