LEGISLATIVE COUNSEL'S DIGEST SB 1089, Johnson. State Water Pollution Control Revolving Fund. Existing law continuously appropriates state and federal funds in the State Water Pollution Control Revolving Fund for the construction of publicly owned treatment works by a municipality, the implementation of a management program, the development and implementation of a conservation and management plan, and other related purposes in accordance with the federal Clean Water Act and the Porter-Cologne Water Quality Control Act. This bill would require the State Water Resources Control Board, for the purposes of administering that fund, to give favorable consideration to certain types of eligible projects, including projects undertaken in response to an administrative enforcement order. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 13481.5 is added to the Water Code, to read: 13481.5. The board, for the purposes of administering the fund, shall give favorable consideration to the following types of eligible projects: projects that address public health problems or the pollution of impaired water bodies, projects necessary to comply with regulatory requirements, water recycling projects, projects undertaken to prevent or minimize water quality degradation, and projects undertaken in response to an administrative enforcement order.
