LEGISLATIVE COUNSEL'S DIGEST AB 827, Committee on Business and Professions. Board membership qualifications: public members. Existing law establishes various boards within the Department of Consumer Affairs to regulate and license various professions and vocations. Under existing law, a person is required to meet specific qualifications for appointment as a public member, including having expertise in the activity regulated by the board. Existing law also prohibits a public member from engaging in, or having engaged in within 5 years prior to his or her appointment, pursuits regulated by the board. This bill would delete this expertise qualification for appointment as a public member. The bill would also prohibit a public member from providing, either presently or in the 5 years prior to his or her appointment, representation to the industry or profession regulated by the board. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 450.4 of the Business and Professions Code is repealed. SEC. 2. Section 450.5 of the Business and Professions Code is amended to read: 450.5. A public member, or a lay member, at any time within five years immediately preceding his or her appointment, shall not have been engaged in pursuits which lie within the field of the industry or profession, or have provided representation to the industry or profession, regulated by the board of which he or she is a member, nor shall he or she engage in those pursuits or provide that representation during his or her term of office.
