LEGISLATIVE COUNSEL'S DIGEST AB 956, Nation. Educators. Existing law authorizes the Commission on Teacher Credentialing to issue 2 types of credentials: teaching credentials and services credentials. This bill would define the term "educator" to mean a certificated person holding a valid California teaching credential or a valid California services credential who is employed by a local education agency or a special education local planning area and who is not employed as an independent contractor or consultant. Under the bill, the definition of educator would not apply to a person participating in a program enacted by statute prior to January 1, 2004, and would apply to a person participating in a program enacted by statute on or after that date only if the statute implementing the program expressly references the definition. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 44013 is added to the Education Code, to read: 44013. (a) "Educator" means a certificated person holding a valid California teaching credential or a valid California services credential issued by the commission who is employed by a local education agency or by a special education local planning area and who is not employed as an independent contractor or consultant. (b) The definition of educator as set forth in subdivision (a) does not apply to a person participating in a program enacted by statute prior to January 1, 2004. (c) The definition of educator as set forth in subdivision (a) applies to a person participating in a program enacted by statute on or after January 1, 2004, only if the statute implementing the program expressly references this section.
