LEGISLATIVE COUNSEL'S DIGEST SB 1773, Soto. Los Angeles County Metropolitan Transportation Authority. Existing law permits the board of the Los Angeles County Metropolitan Transportation Authority, upon meeting specified requirements, to form special benefit assessment districts and to levy special benefit assessments on real property within those districts. Existing law authorizes an owner of real property within a benefit assessment district to petition for the exclusion of all or part of the property from the assessment, or for reduction of the assessment. This bill would require a petition for exclusion or reduction to be commenced within two years after the making of the payment sought to be refunded. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 33021 is added to the Public Utilities Code, to read: 33021. Notwithstanding Section 5097 of the Revenue and Taxation Code, any petition or claim for refund seeking an exclusion of real property or the reduction of an assessment on any grounds for the 2004-05 fiscal year or in any subsequent fiscal year pursuant to this chapter shall be filed within two years after the making of the payment sought to be refunded.
