LEGISLATIVE COUNSEL'S DIGEST AB 2155, Vargas. San Diego County Regional Airport Authority. (1) Existing law authorizes the board of the San Diego County Regional Airport Authority to act by ordinance or resolution for the regulation of the authority and undertaking acts necessary and convenient for the exercise of the authority's powers. This bill would authorize the authority to adopt and enforce rules and regulations for the administration, maintenance, operation, and use of its facilities and services. The bill would provide that a person who violates a rule, regulation, or ordinance adopted by the board is guilty of a misdemeanor or an infraction, as specified, thereby imposing a state-mandated local program by creating a new crime. The bill would authorize the authority to employ necessary personnel to enforce these provisions. The bill would declare that its provisions do not change existing law. (2) The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 170042 of the Public Utilities Code is amended to read: 170042. (a) The board may act only by ordinance or resolution for the regulation of the authority and undertaking all acts necessary and convenient for the exercise of the authority's powers. (b) The authority may adopt and enforce rules and regulations for the administration, maintenance, operation, and use of its facilities and services. (c) (1) A person who violates a rule, regulation, or ordinance adopted by the board is guilty of a misdemeanor punishable pursuant to Section 19 of the Penal Code, or an infraction under the circumstances set forth in paragraph (1) or (2) of subdivision (d) of Section 1 of the Penal Code. (2) The authority may employ necessary personnel to enforce this section. (d) A majority of the membership of the board shall constitute a quorum for the transaction of business. SEC. 2. The amendment of Section 170042 of the Public Utilities Code made by Section 2 of this act does not constitute a change in, but is declaratory of, existing law. SEC. 3. No reimbursement is required by this act pursuant to Section 6 of Article XIII B of the California Constitution because the only costs that may be incurred by a local agency or school district will be incurred because this act creates a new crime or infraction, eliminates a crime or infraction, or changes the penalty for a crime or infraction, within the meaning of Section 17556 of the Government Code, or changes the definition of a crime within the meaning of Section 6 of Article XIII B of the California Constitution.
