LEGISLATIVE COUNSEL'S DIGEST AB 85, Wiggins. County employees' retirement: continuous service. The County Employees Retirement Law of 1937 prescribes the method for calculating service credit for service that was temporary, seasonal, intermittent, or part time. Eligibility for various retirement benefits under that law is based, in part, on a member's years of continuous service. This bill would provide that service credit based on temporary, seasonal, intermittent, or part-time service by a member would be credited as continuous service by the member. The bill would state that its provisions are declaratory of existing law. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 31640.5 of the Government Code is amended to read: 31640.5. Where service for which a member receives credit, either prior to or during membership, is on a tenure which is temporary, seasonal, intermittent, or part time only, the member shall receive credit as continuous service for that proportion of the time he or she held the position as the time he or she actually was engaged in the performance of the duties of the position bears to the time required to perform the same duties in a full-time position. A "year of service" in the position shall be construed to mean the time during which the member has earned one full year of credit, calculated as provided in this section. SEC. 2. The provisions of this act are declaratory of existing law.
