                        FEBRUARY 6, 2006

An act to amend Section 10150.6 of the Business and Professions
Code, relating to real estate brokers.

	LEGISLATIVE COUNSEL'S DIGEST

AB 1963, Leslie Real estate brokers: license.
Existing law, the Real Estate Law, provides for the licensure and
regulation of real estate salespersons and real estate brokers. Under
existing law, the Real Estate Commissioner may issue a real estate
broker's license to an applicant who (1) has at least the equivalent
of 2 years' general real estate experience or graduated from a 4-year
college or university course, (2) files a written petition with the
Department of Real Estate setting forth his or her qualifications and
experience, and the commissioner approves, and (3) passes an
examination and satisfies other requirements.
This bill would delete the requirement that the applicant have at
least the equivalent of 2 years' general real estate experience or
graduation from a 4-year college or university course. The bill would
waive the other 2 requirements for an applicant who is a member of
the State Bar of California.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

SECTION 1. Section 10150.6 of the Business and Professions Code is
amended to read:
10150.6. (a) Except as provided in subdivision (b), the Real
Estate Commissioner shall not grant an original real estate broker's
license to any person unless that person has held a real estate
salesperson's license for at least two years and qualified for
renewal real estate salesperson status, within the five-year period
immediately prior to the date of his or her application for the
broker's license, and during that time he or she was actively engaged
in the business of a real estate salesperson.
   (b) If an applicant for a real estate broker's license files a
written petition with the Department of Real Estate setting forth his
or her real estate related qualifications and experience, and the
commissioner approves, he or she may be issued a real estate broker's
license immediately upon passing the examination and satisfying the
other requirements of this article.
   (c) The commissioner shall waive the requirements of this section
for an applicant who is a member of the State Bar of California.
