An act to add Article 3.7 (commencing with Section 92037) to
Chapter 1 of Part 57 of the Education Code, relating to public
postsecondary education.
LEGISLATIVE COUNSEL'S DIGEST
AB 2179, Leslie Public postsecondary education: indemnification:
Regents of the University of California.
Existing law establishes the University of California, under the
administration of the Regents of the University of California, as one
of the 3 segments of public postsecondary education in this state.
This bill would, notwithstanding any other provision of law,
indemnify current or former regents, officers, and employees of the
university, current or former investment managers under contract with
the university, and current or former officers, directors, trustees,
agents, or employees of university foundations from all claims,
demands, suits, actions, damages, judgments, costs, charges, and
expenses, including court costs and attorney's fees, and all
liability, losses, and damages of any nature whatsoever that these
persons may at any time sustain by reason of any decision of the
regents not to invest in any firm or firms with business operations
in Sudan or with the Sudanese government.
THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:
SECTION 1. Article 3.7 (commencing with Section 92037) is added to
Chapter 1 of Part 57 of the Education Code, to read:
Article 3.7. Indemnification of Regents, Officers, Employees,
and Contractors
92037. Notwithstanding any other provision of law, all of the
following shall be indemnified from the state General Fund from all
claims, demands, suits, actions, damages, judgments, costs, charges,
and expenses, including court costs and attorney's fees, and
indemnified against all liability, losses, and damages of any nature
whatsoever that these persons may at any time sustain by reason of
any decision of the regents not to invest in any firm or firms with
business operations in Sudan or with the Sudanese government:
(a) Any current or former members of the regents, jointly and
individually.
(b) Any current or former officers or employees of the University
of California.
(c) Any current or former investment managers under contract, or
formerly under contract, with the University of California.
(d) Any current or former officers, directors, trustees, agents,
or employees of any University of California foundation.
