   SB 635, as amended, Alarcon.  Advancement Via Individual
Determination (AVID) program.
   The existing Budget Act of 2004, appropriates $9,035,000 for the
Advancement Via Individual Determination (AVID) program to provide
training to teachers and school leaders and assistance to schools in
implementing the program to help pupils who might not otherwise
attend college prepare for, and be successful in college.  
   This bill would appropriate $10,000,000 from the General Fund to
the State Department of Education for the support of the program. The
bill would require $4,100,000 to be expended to restore funding to
the program and targeted to secondary schools that rank in the 1st to
5th deciles on the Academic Performance Index and $5,900,000 to be
expended to augment funding for the program and targeted to secondary
schools that rank in the 1st to 5th deciles on the Academic
Performance Index. The bill would make these amounts applicable
toward the minimum funding requirements for school districts and
community college districts imposed by Section 8 of Article XVI of
the California Constitution.  
   The bill would make legislative findings and declarations
regarding that program.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:


  SECTION 1.
   The Legislature finds and declare all of the following:
   (a) Eleven percent of the pupils in the first to fifth deciles on
the Academic Performance Index are African-American and 69 percent
are Latino.
   (b) Funding for the Advancement Via Individual Determination
(AVID) program that has been, or is proposed to be, reduced should be
restored and targeted to secondary schools that rank in the first to
fifth deciles on the Academic Performance Index. Restoration of this
funding will allow the state to reach an estimated additional 30,000
pupils in 300 secondary schools with proven strategies to help high
school pupils pass the California High School Exit Exam (CAHSEE) and
take Advanced Placement (AP) courses, which will make those pupils
competitive for admission to the state's colleges and universities.

   (c) Funding for the AVID program should be augmented and targeted
to secondary schools that rank in the 1st to 5th deciles on the
Academic Performance Index. Augmenting the funding for the AVID
program is the most cost-effective way to reach an estimated
additional 90,000 low-income, disadvantaged pupils in 900 of the
neediest secondary schools and would dramatically increase the number
of underrepresented pupils eligible for, and attending, the
University of California and the California State University.

  SEC. 2.
   The sum of ten million dollars ($10,000,000) is hereby
appropriated from the General Fund to the State Department of
Education for the support of the Advancement Via Individual
Determination (AVID) program for expenditure as follows:
   (a) The sum of four million one hundred thousand dollars
($4,100,000) shall be expended to restore funding to the AVID program
and targeted to secondary schools that rank in the 1st to 5th
deciles on the Academic Performance Index.
   (b) The sum of five million nine hundred thousand dollars
($5,900,000) shall be expended to augment funding for the AVID
program and targeted to secondary schools that rank in the 1st to 5th
deciles on the Academic Performance Index.   
  SEC. 3.
   For the purposes of making computations required by Section 8 of
Article XVI of the California Constitution, the appropriation made by
this act shall be deemed to be "General Fund revenues appropriated
to school districts," as defined in subdivision (c) of Section 41202
of the Education Code for the 2005-06 fiscal year and be included
within the "total allocations to school districts and community
college districts from General Fund proceeds of taxes appropriated
pursuant to Article XIII B," as defined in subdivision (e) of Section
41202 of the Education Code for the 2005-06 fiscal year.
