DIGEST : This bill makes various technical,
non-substantive changes to the Government Code, the Public
Utilities Code, the Streets and Highway Code, the Public
Contract Code, the Public Resources Code, and the Vehicle
Code.
Assembly Amendments delete the portion of the bill giving
the Secretary of the Business, Transportation and Housing
Agency authority to add a representative to the joint
policy committee formed to analyze the feasibility of
consolidating functions separately performed by the
Association of Bay Area Governments and the Metropolitan
Transportation Commission. In addition, the amendments add
new, technical, non-controversial sections (see items 4-11
below).
ANALYSIS : Existing law includes various provisions
relating to the Department of Motor Vehicles, Department of
Transportation, the California Highway Patrol, and other
public agencies.
This bill is a committee bill and is intended to deal with
minor, non-controversial transportation-related issues by
making technical and clarifying changes in the law and
repealing obsolete statutory provisions.
Specifically, the bill does the following:
1. Makes obsolete provisions relating to the State
Transportation Improvement Program consistent with
certain provisions relating to the funding of projects
from the State Aeronautics Account. (Source:

2. Resolves conflicts with provisions relating to the
Department of Transportation's Equipment Service Fund
with pertinent federal requirements. (Source:

3. Authorizes the Department of Motor Vehicles to accept
vehicle registration fees up to 75 days prior to the
expiration of the current registration of a vehicle.

4. Corrects a statutory omission in Senate Bill 1107
(Chapter 230, Statutes of 2004), relating to vehicle
pollution inspection. (Source: California Motor Car

5. Specifies that weekend days and holidays are not
counted as part of the five-day period after a bid has
been submitted to a public agency in which the bidder
has the opportunity to claim that the bid includes a
mistake that makes it "materially different than (the
bidder) intended it to be." (Source: Department of

6. Makes a word conforming change to the Public
Resources Code Sec. 5090.02. (Source: Department of

7. Makes a grammatical correction to one word and other
technical conforming changes within the Public
Resources Code Sec. 5090.09. (Source: Department of

8. Recasts two subdivisions within Public Resources Code
Sec. 5090.35 to provide a more logical ordering of the
information.
9. Adds "snowmobile dealer" to Vehicle Code Sec. 285
("dealer" section), which corrects a technical

10. Deletes the incorrect title "deputy chief"
(California Highway Patrol) included in Vehicle Code

Comments
This is one of two transportation-related committee bills
(the other bill is SB 710) that have been introduced this
year by members of the Senate Transportation and Housing
Committee. The provisions that are included in the bill

generally entail only non-substantive changes and
corrections in the law which has no expressed opposition.
It is the practice of the Committee to remove any provision
from the bill that generates opposition.
