          STAFF COMMENTS: 
          
          Current law requires that rigid plastic containers sold in the  
          state be manufactured with recycled content.  The amount of  
          recycled material which must be included depends on the type of  
          plastic.  

          A manufacturer may meet the requirements by one of two other  
          alternatives:  (a) consuming a comparable volume of recyclable  
          material in its other manufactured RPPC products, or (b)  
          arranging for the consumption of comparable volume out of state.  
           This bill clarifies these alternatives by: (a) providing that  
          the comparable volume of material does not need to be in the  
          manufacturer's RPPC products, and (b) providing that the  
          comparable volume may be exported out-of-state, but not out of  
          the US.
          
          According to the Integrated Waste Management Board, the bill  
          could be implemented with two staff in 2006-07, at a cost of  
          over $100,000.  These costs would be for developing and  
          promulgating regulations.  In subsequent years, the board  










          anticipates the need for minor, on-going enforcement effort.    
          The Integrated Waste Management Account would finance these  
          costs.
