LEGISLATIVE COUNSEL'S DIGEST AB 367, Nakanishi Physician and surgeon's fee waiver. Existing law, the Medical Practice Act, provides for the licensure and regulation of physicians and surgeons by the Medical Board of California. Under the act, an applicant for a physician and surgeon's certificate is required to submit a fee payment with his or her application. The act waives this requirement for the renewal of a certificate if the applicant certifies to the board that the renewal is for the sole purpose of providing voluntary, unpaid service in specified settings. This bill would also waive the application fee for the initial issuance of a physician and surgeon's certificate if the applicant makes this same certification to the board. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 2083 of the Business and Professions Code is amended to read: 2083. (a) Except as provided in subdivision (b), each application for a certificate shall be accompanied by the fee required by this chapter and shall be filed with the Division of Licensing. (b) The license fee shall be waived for a physician and surgeon who certifies to the Medical Board of California that the issuance of the license or the renewal of the license is for the sole purpose of providing voluntary, unpaid service to a public agency, not-for-profit agency, institution, or corporation that provides medical services to indigent patients in medically underserved or critical-need population areas of the state.
