LEGISLATIVE COUNSEL'S DIGEST AB 2372, Pavley Public projects: sanction for noncompliance. Under existing law a public agency can elect to be subject to the California Uniform Public Construction Cost Accounting Act, which authorizes bidding procedures for public projects, as specified. Existing law requires the California Uniform Construction Cost Accounting Commission, upon the request of an interested party, to review the bidding practices of a participating public agency to determine if the agency has violated the act. This bill would provide that a participating public agency, for which the commission has, on 3 occasions within a 10-year period, determined that the agency has not complied with the bidding procedures authorized by the act, is prohibited from using those bidding procedures for a period of 5 years, as specified. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 22044.5 is added to the Public Contract Code, to read: 22044.5. If the commission makes a finding, in accordance with Section 22043, on three separate occasions within a 10-year period, that the work undertaken by a public agency falls within any of the categories described in Section 22042, the commission shall notify the public agency of that finding in writing by certified mail and the public agency shall not use the bidding procedures provided by this article for five years from the date of the commission's findings.
