LEGISLATIVE COUNSEL'S DIGEST AB 2401, Karnette Vehicles: autoettes. (1) Existing law requires operating motor vehicles to be registered by the Department of Motor Vehicles. Existing law makes it a crime to violate any provision of the Vehicle Code. This bill would require the department to register autoettes, as defined, as motor vehicles. The bill would also require the owner of the autoette to remove the license plates from the vehicle and return them to the department if the vehicle is removed from a natural island, as described. Because the failure to remove the license plates would create a new crime, this bill would impose a state-mandated local program. (2) The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 175 is added to the Vehicle Code, to read: 175. An "autoette" is a motor vehicle, located on a natural island with an area in excess of 20,000 acres and that is within a county having a population in excess of 4,000,000, that meets all of the following requirements: (a) Has three or more wheels in contact with the ground. (b) Has an unladed weight of no greater than 1,800 pounds. (c) Has an overall length of no more than 120 inches, including the front and rear bumpers. (d) Has a width of no more than 55 inches, as measured from its widest part. SEC. 2. Section 4000.5 is added to the Vehicle Code, to read: 4000.5. (a) The department shall register an autoette, as defined in Section 175, as a motor vehicle. (b) The owner of an autoette shall remove the license plates from the vehicle and return them to the department when the autoette is removed from a natural island, as described in Section 175. SEC. 3. No reimbursement is required by this act pursuant to Section 6 of Article XIII B of the California Constitution because the only costs that may be incurred by a local agency or school district will be incurred because this act creates a new crime or infraction, eliminates a crime or infraction, or changes the penalty for a crime or infraction, within the meaning of Section 17556 of the Government Code, or changes the definition of a crime within the meaning of Section 6 of Article XIII B of the California Constitution.
