AB 271, as introduced, Cook. Illegal immigration: public benefits.
Existing federal law requires any state that provides in-state
tuition or other higher education benefits to undocumented immigrants
to provide the same level of tuition to out-of-state residents.
Existing federal law also prohibits, except as prescribed, the
provision of state or local public benefits, as defined, to aliens
who are not qualified aliens, except that federal law permits a state
to provide for the eligibility of these aliens for state and local
public benefits by a statute enacted after August 22, 1996, that
affirmatively provides for that eligibility. Existing law contains
provisions regarding the provision of specified benefits and service
to persons not legally residing in California.
This bill would declare the Legislature's intent to enact
legislation that would prohibit any person who resides illegally in
California from receiving the same benefits and privileges as a
person who resides legally in this state and would require proof of
citizenship to receive any form of state-funded benefits.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:
SECTION 1. It is the intent of the Legislature to enact
legislation that would prohibit any person who resides illegally in
California from receiving the same benefits and privileges as a
person who resides legally in the state and would require proof of
citizenship to receive any form of state-funded benefits.
