Energy: Energy Conservation Assistance Act of 1979:
repayment.
The Energy Conservation Assistance Act of 1979 (act) requires an
eligible institution receiving an allocation from the act to repay
the principal amount of the allocation plus interest, in not more
than 30 equal semiannual payments, as determined by the State Energy
Resources Conservation and Development Commission.
This bill would increase the maximum number of semiannual payments
to 60.
Existing law establishes various requirements for energy and
design criteria for buildings. Existing law defines "sustainable
green building" for purposes relating to energy management plans of
community colleges.
This bill would state the intent of the Legislature to enact
legislation to develop a uniform definition for "green building" and
to extend tax and planning incentives to developers to build green
buildings.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:
SECTION 1. Section 25415 of the Public
Resources Code is amended to read:
25415. (a) Each eligible institution to which an allocation has
been made under this chapter shall repay the principal amount of the
allocation, plus interest, in not more than 30
60 equal semiannual payments, as determined by the
commission. The first semiannual payment shall be made on or before
December 22 of the fiscal year following the year in which the
project is completed. The repayment period may not exceed the life of
the equipment, as determined by the commission or the lease term of
the building in which the energy conservation measures will be
installed.
(b) Notwithstanding any other provision of law, the commission
shall, unless it determines that the purposes of this chapter would
be better served by establishing an alternative interest rate
schedule, periodically set interest rates on the loans based on
surveys of existing financial markets and at rates not less than 3
percent per annum.
(c) The governing body of each eligible institution shall annually
budget an amount at least sufficient to make the semiannual payments
required in this section. The amount shall not be raised by the levy
of additional taxes but shall instead be obtained by a savings in
energy costs or other sources.
SECTION 1. It is the intent of the Legislature
to enact legislation to develop a uniform statewide definition for
"green building," as it relates to private and nonprofit development
projects, and to extend tax and planning incentives to developers to
build green buildings.
