   An act to add Section 30222.3 to the Public Resources Code,
relating to coastal resources.


	LEGISLATIVE COUNSEL'S DIGEST


   AB 1459, as introduced, Levine. California Coastal Act of 1976:
coastal development.
   The California Coastal Act of 1976 provides that the use of
private lands suitable for visitor-serving commercial recreational
facilities designed to enhance public opportunities for coastal
recreation shall have priority over private residential, general
industrial, or general commercial development, but not over
agriculture or coastal-dependent industry.
   This bill would prohibit in the coastal zone a unit in an
overnight visitor-serving commercial facility from being sold for
individual ownership or being used for part-time private occupancy.
The bill would also prohibit in the coastal zone the conversion, in
whole or part, of an overnight visitor-serving commercial facility to
a full-time or part-time private residential facility.
   Vote: majority. Appropriation: no. Fiscal committee: yes.
State-mandated local program: no.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  Section 30222.3 is added to the Public Resources Code,
to read:
   30222.3.  Both of the following are prohibited in the coastal
zone:
   (a) The sale or transfer of a unit in an overnight visitor-serving
commercial facility, for individual ownership or for part-time
private occupancy.
   (b) The conversion, in whole or part, of an overnight
visitor-serving commercial facility to a full-time or part-time
private residential facility.
