It also increases existing fines for nonspayed or unneutered dogs and cats. Requires microchipping of the animal for a second occurrence for which the owner will have to pay the cost of the microchip procedure, as specified. CONTINUED AB 1634 Page 2 Senate Floor Amendments of 8/12/08 name the bill the "California Responsible pet Ownership Act;" delete complaints as the trigger for citations and civil penalties and instead substitute the intact status of an unlicensed dog or cat as the trigger for citations and civil penalties; impose civil penalties on the owner of an at-large, intact dog, even if the animal is licensed; require local enforcers to give the animal owner's written notice about the consequences of violating the law; change the civil penalties by requiring microchipping on the second offense; specify when a local animal control agency must (and may) waive the fines; change the method of counting time from business days to calendar days; exempt out-of-state dogs and cats, exempt certain dogs and cats from microchipping and spaying or neutering; and require local officials to discount dog and cat licenses to or less if the animal has been microchipped, or less if the animal has been spayed or neutered, or less if the animal has been spayed or neutered and microchipped. ANALYSIS : State law requires animal control agencies and shelters to spay or neuter the dogs and cats that they sell or give away. For dogs and cats that are injured or too sick to be spayed or neutered, state law requires the adopter to agree to have the animal sterilized at a later date and pay a sterilization deposit. State law requires fines for the owners of nonspayed or neutered dogs and cats that are impounded: 1.First occurrence: $35. 2.Second occurrence: $50. 3.Third and subsequent occurrences: $100. The funds must be spent for humane education, spaying and neutering, and administrative costs (AB 1856 [Vincent], Chapter 747, Statutes of 1998 and SB 1301 [Vincent], Chapter 253, Statutes of 2004). The Legislature has declared that the overpopulation of dogs and cats is "a problem of great public concern," noting that overpopulation causes public health problems, affecting local animal control departments, and results in CONTINUED AB 1634 Page 3 euthanizing too many cats and dogs (AB 1856 [Vincent], Chapter 747, Statutes of 1998). Local animal shelters must care for stray and impounded dogs and cats for six days before euthanizing them (SB 1785 [Hayden], Chapter 752, Statutes of 1998). In 2008-09, local governments claimed about $23 million for the costs of this state mandated local program. The Department of Public Health (DPH) tracks local shelter statistics by requiring local officials to report rabies cases. Officials regulate dogs and cats under a mix of state laws and local ordinances. Some cities and counties have ordinances that require owners to spay or neuter their cats and dogs. State law allows cities and counties to adopt programs to control dangerous dogs that are more restrictive than state law, but these local ordinances can't be breed specific. However, local officials can adopt breed-specific ordinances for their mandatory spay or neuter programs and breeding requirements (SB 861 [Speier], Chapter 668, Statutes of 2005). This bill enacts the "California Responsible Pet Ownership Act." Citations and Penalties . This bill specifies that a person who owns a dog or cat that is not licensed (or is improperly licensed) and that has not been spayed or neutered may be cited and, if cited, must pay civil penalties. A person who owns an intact, property licensed dog or cat that is at large may be cited and, if cited, must pay civil penalties. For dogs, this bill specifies these civil penalties: 1.First occurrence: $50. 2.Second occurrence for the same dog: $100 and microchipping the dog, with the owner paying for the procedure's cost. 3.Third occurrence for the same dog: spaying or neutering the dog, with the owner paying for the procedure's cost. CONTINUED AB 1634 Page 4 For cats, this bill specifies these civil penalties: 1.First occurrence: $50 and microchipping the cat, with the owner paying for the procedure's cost. 2.Second occurrence for the same cat: spaying or neutering the cat with the owner paying for the procedure's cost. Information . When issuing a citation, this bill requires the local animal control agency to give the animal's owner information about the availability of spaying and neutering services. Further, this bill requires the local animal control agency to give the animal's owner written notice of the civil penalties for the second and third citation, including microchipping and spaying or neutering the animal. Penalty Payments . This bill requires the animal's owner to pay the civil penalty within 30 calendar days. This bill requires the local animal control agency to waive the civil penalty if, within 14 calendar days, the animal's owner presents written proof from a veterinarian that the animal was spayed or neutered. This bill requires the local animal control agency to waive at least $30 of the civil penalty for the first occurrence (and may waive the entire $50) if the owner voluntarily microchips the intact dog. Exemptions . This bill exempts from its provisions an animal owner who is not a California resident if the owner provides proof that the animal is temporarily in California for training, showing, or another lawful reason. This bill exempts an animal from microchipping and spaying or neutering, if the owner provides a California veterinarian's detailed letter stating that the animal's age, poor health, or illness makes the procedure unsafe. Local Ordinances . This bill allows local officials to adopt more restrictive ordinances or penalties. Impounded Animals . For the owners of impounded, nonspayed or unneutered dogs, this bill increases the existing fines: 1.First occurrence: from $35 to $50. CONTINUED AB 1634 Page 5 2.Second occurrence: from $50 to $100 and microchipping the dog, with the owner paying for the procedure's cost. 3.Third occurrence: from $100 to mandatory spaying or neutering the dog, with the owner paying for the procedure's cost. For the owners of impounded nonspayed or unneutered cats, this bill increases the existing fines: 1.First occurrence: from $35 to $50. 2.Second occurrence: from $50 to mandatory spaying or neutering the cat, with the owner paying for the procedure's cost. License Fees . This bill requires local officials to discount dog and cat licenses to: 1. or less if the animal has been microchipped. 2. or less if the animal has been spayed or neutered. 3. or less if the animal has been spayed or neutered and microchipped. Comments Tackling the problems caused by dog and cat overpopulation requires the combined efforts of animal owners, pet breeders, veterinarians, private organizations, local officials, and state leaders. Many owners and breeders already control the number and sizes of their animals' litters. Many veterinarians contribute their services to free and low-cost spay and neuter programs. Private organizations actively educate the public about overpopulation problems and solutions. Local officials have adopted local ordinances to curb dog and cat overpopulation. Yet despite these efforts and some successes, California still endures the problems caused by overpopulation. This bill confronts the problem of dog and cat overpopulation by building on the 1998 law that requires the owners of impounded animals to pay fines if their pets aren't spayed or neutered. This bill CONTINUED AB 1634 Page 6 complements that 10-year old law by imposing civil penalties on owners whose animals' behavior generates complaints. Owning and caring for dogs and cats is deeply emotional for many people. Some pet owners resent even the existing state and local government limits on how they treat their animals, believing that these decisions are best left to the owners themselves. Responsible pet owners and breeders want what's best for their dogs and cats. Although many owners acknowledge the public health and public finance problems caused by unregulated pet overpopulation, they oppose government requirements for spaying or neutering animals. But not all animal owners are responsible. Uncontrolled litters result in inappropriate cross-breeding, feral cats, and unwanted dogs. Those who fail to take personal responsibility for their animals create expensive problems for all taxpayers. This bill offers local officials the state law they need to focus attention on the dogs and cat that don't behave. For at least 50 years, the State of California has required local health departments to submit regular reports on cases of rabies among animals. The Veterinary Public Health Section of DPH collects these data into statewide reports. The state's reporting forms are so detailed that state officials can track the population of dogs and cats in local animal shelters. However, the results are reliable only if all counties report on time. To improve data collection, this bill postpones paying local officials for their costs of the state mandated longer shelter stays until county health officials comply with the long-standing reporting requirement. With better data, the public can track the effectiveness of this bill. ARGUMENTS IN SUPPORT : According to California Taxpayers for Safe and Healthy Pets, "Roaming animals create untold numbers of accidental pregnancies. According to the Department of Public Health, over 800,000 dogs and cats are abandoned annually in our state; this costs taxpayers over $250 million each year. Over half of these pets, 400,000 of them, are not adopted and thus are euthanized at taxpayer expense. Unaltered dogs are three times more likely to CONTINUED AB 1634 Page 7 bite, and almost 40,000 people in California are attacked and bitten by dogs and cats each year. Children are the most common victims. "AB 1634 is a common sense tool that allows law enforcement to target roaming animals, prevent unplanned animal litters and reduce animal attacks. The law requires the owner of a nonspayed or unneutered dog or cat to be cited for being intact, if the animal is the subject of a valid complaint indicating that the owner has violated state or local animal control laws. At any occurrence, the penalty is waived if the animal is spayed or neutered. "Current state law already provides additional fines for the owners of impounded nonspayed or unneutered animals. CONTINUED AB 1634 Page 8 They contend that this bill does not apply to animals that are caught up in "neighbor disputes" or are the subject of unwarranted complaints, and does not apply to violations related to excessive noise such as dog barking. They further contend that animals cited under the provisions of AB 1634 are accorded the exact same due process and appeals rights granted to them for any violation of state or local animal control laws. ARGUMENTS IN OPPOSITION : The opposition argues that this bill requires that all dogs be spayed or neutered. It makes no exceptions for young puppies, sick dogs, breeding stock, police dogs, service dogs, dogs visiting from out of state. Under this bill every dog and cat in the state must be spayed or neutered or the owner can be cited for any complaint regardless of the truth of the complaint. Opponents argue that this bill will not significantly lower shelter numbers or sheltering costs because it will be costly for local governments to administer. They are concerned that the bill does not address the health considerations associated with spaying and neutering animals at an early age, especially affecting the long-term health of working breeds or any dog that participates in working or athletic events. Some points to the opposition include (1) shelter euthanasia will increase for a few years as people give up their pets they can't afford to spay or neuter, (2) licensing rates and vaccinations will decrease as people "hide" from the legislation, (3) revenue from licensing and vaccination programs will decline, (4) small breeders will vanish from the open market immediately to save their breeds from extinction in California, (5) dog and Cat shows and events will fade away, taking with them with the significant tourism revenue generated by these events, (6) commercial breeding, puppy smuggling from abroad will increase resulting in unhealthy, poor quality pet populations, (7) enforcement of this law is impractical so accidental litter rates will decline only slowly and 8) Feral cat populations will be largely unaffected.
