An act to add Section 56321.6 to the Education Code, relating to
special education.

AB 2555, Torrico. Special education: initial assessment:
individualized education program.
Existing law requires that the parent or guardian of a pupil be
given, in writing, a proposed assessment plan within 15 days of the
referral of the pupil for an assessment for the development or
revision of an individualized education program, unless the parent or
guardian agrees, in writing, to an extension. Existing law requires
that a copy of the notice of a parent's or guardian's rights be
attached to the assessment plan. Existing law establishes state
special schools, including the California School for the Deaf and the
California School for the Blind, as part of the public school system
of the state.
This bill would require that the copy of the notice of parent
rights include information regarding the state special schools for
pupils who are deaf, hard of hearing, blind, visually impaired, or
deaf-blind.
By requiring local educational agencies to include additional
information in the copy of the notice of parent rights attached to
the assessment plan, this bill would impose a state-mandated local
program.
The California Constitution requires the state to reimburse local
agencies and school districts for certain costs mandated by the
state. Statutory provisions establish procedures for making that
reimbursement.
This bill would provide that, if the Commission on State Mandates
determines that the bill contains costs mandated by the state,
reimbursement for those costs shall be made pursuant to these
statutory provisions.
THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:
SECTION 1. Section 56321.6 is added to the Education Code, to
read:
56321.6. The copy of the notice of parent rights shall include
information regarding the state special schools for pupils who are
deaf, hard of hearing, blind, visually impaired, or deaf-blind.
SEC. 2. If the Commission on State Mandates determines that this
act contains costs mandated by the state, reimbursement to local
agencies and school districts for those costs shall be made pursuant
to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of
the Government Code.
