   An act to add Section 5006.15 to the Public Resources Code,
relating to parks.


	LEGISLATIVE COUNSEL'S DIGEST


   SB 421, as introduced, Ducheny. Department of Parks and
Recreation: acquisition of property.
   Existing law authorizes the Department of Parks and Recreation,
with the consent of the Department of Finance, to acquire title to or
any interest in real property, that the department deems necessary
or proper for the extension, improvement, or development of the state
park system.
   This bill would authorize the department to acquire, by donation
or purchase, real property that is subject to a conservation
easement, deed restriction, or other limitation, if the director of
the department determines that the conservation easement, deed
restriction, or other limitation is consistent with and promotes the
purposes for which the property is to be acquired.
   Vote: majority. Appropriation: no. Fiscal committee: yes.
State-mandated local program: no.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  Section 5006.15 is added to the Public Resources Code,
to read:
   5006.15.  The department may acquire real property by donation or
purchase that is subject to a conservation easement, deed
restriction, or other limitation, if the director determines that the
conservation easement, deed restriction, or other limitation is
consistent with and promotes the purposes for which the property is
to be acquired.
