   An act to add Sections 12290 and 12309.7 to the Elections Code,
relating to elections.

   SB 448, as introduced, Margett. Election procedures.
   Existing law contains restrictions on where polling places may be
located, and prohibits a place where the primary purpose is the sale
and dispensation of alcoholic beverages from being used as a polling
place.
   This bill would prohibit a place that is the residence of a
registered sex offender, as described, from being used as a polling
place. The bill would also prohibit a registered sex offender from
working in any capacity at the polls. By imposing new duties on local
elections officials, the bill would create a state-mandated local
program.
   The California Constitution requires the state to reimburse local
agencies and school districts for certain costs mandated by the
state. Statutory provisions establish procedures for making that
reimbursement.
   This bill would provide that, if the Commission on State Mandates
determines that the bill contains costs mandated by the state,
reimbursement for those costs shall be made pursuant to these
statutory provisions.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  Section 12290 is added to the Elections Code, to read:
   12290.  A place that is the residence of a registered sex
offender, pursuant to Section 290 of the Penal Code, shall not be
used as a polling place.
  SEC. 2.  Section 12309.7 is added to the Elections Code, to read:
   12309.7.  A person who is a registered sex offender, pursuant to
Section 290 of the Penal Code, shall not work in any capacity at the
polls.
  SEC. 3.  If the Commission on State Mandates determines that this
act contains costs mandated by the state, reimbursement to local
agencies and school districts for those costs shall be made pursuant
to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of
the Government Code.
