An act to amend Section 13997.1 of the Government Code, relating
to international trade.

SB 515, Scott. International trade and investment office: Yerevan.
(1) Existing law requires the Governor to instruct the Secretary
of Business, Transportation and Housing to establish, on a contract
basis, an international trade and investment office in Yerevan, in
the Republic of Armenia, to serve the region of Eastern Europe and
Western Asia, subject to the availability of funds for that purpose.
The secretary is required to submit a report to the Legislature on
the success of the office, to include specified components, no later
than June 1, 2007. These provisions are repealed as of January 1,
2008.
This bill would instead specify that the office is to serve the
region of Armenia and the Commonwealth of Independent States. It
would extend the date of the submission of the report to March 1,
2009, and revise the required components of the report. It would
extend the repeal date to January 1, 2010, and would prohibit the use
of state resources for the support or operation of the office, other
than for the costs associated with management of the contract
agreement.
(2) Existing law sets forth the requirements for the establishment
and administration of international trade and investment offices
under the supervision of the Business, Transportation and Housing
Agency generally.
This bill would declare the intent of the Legislature that any
extension of the international trade and investment office
established in Yerevan beyond January 1, 2010, conform to these
requirements to the extent possible.
THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:
SECTION 1. Section 13997.1 of the Government Code is amended to
read:
13997.1. (a) The Governor shall instruct the Secretary of
Business, Transportation and Housing to establish, on a contract
basis, an international trade and investment office in Yerevan, in
the Republic of Armenia, to serve the region of Armenia and the
Commonwealth of Independent States.
(b) The secretary shall report to the Legislature on the success
of the international trade and investment office in Yerevan no later
than March 1, 2009. The report shall include, but not be limited to,
information on the extent to which the performance objectives
included in the scope of work for the office were achieved with a
reasonable level of effectiveness and efficiency.
(c) This section shall be implemented only to the extent that
funds are available to the Business, Transportation and Housing
Agency for this purpose from any source, including, but not limited
to, federal funding and private donations authorized pursuant to
Section 13997. Private donations made pursuant to Section 13997 and
specified for the international trade and investment office in
Yerevan shall be deposited in a separate subaccount within the
Economic Development and Trade Promotion Account and may be used only
for the operation of this office. No state resources shall be used
to support or operate the trade office, other than for the costs
associated with management of the contract agreement.
(d) This section shall remain in effect only until January 1,
2010, and as of that date is repealed, unless a later enacted
statute, that is enacted before January 1, 2010, deletes or extends
that date.
SEC. 2. It is the intent of the Legislature that any extension of
the international trade and investment office established pursuant to
Section 13997.1 of the Government Code beyond January 1, 2010,
shall, to the extent possible, conform to the requirements of Section
13996.7 of the Government Code and any other applicable provisions
of Chapter 2.5 (commencing with Section 13996.4) of Part 4.7 of
Division 3 of Title 2 of the Government Code relating to the
operation of international trade and investment offices.
