An act to add Section 49079.5 to the Education Code, relating to
pupils.

SB 741, as amended, Ackerman. Pupils: identifying information.
Existing law requires a school district, which is defined to
include a district or school offering instruction in any of
kindergarten and grades 1 to 12, inclusive, the office of the county
superintendent of schools, or a special school operated by the State
Department of Education, to adopt a policy identifying the categories
of directory information, such as the name, address, telephone
number, and date and place of birth of a pupil, that may be released.
The school district also is required to determine which individuals,
officials, or organizations may receive directory information. A
school district is not authorized to permit access to pupil records
to any person without written parental consent or under judicial
order except that access to those particular records relevant to the
legitimate educational interests of the requester are required to be
permitted, and except as otherwise specified.
This bill would encourage, from January 1, 2008, to June 30, 2008,
inclusive, a school district that has the ability to omit the social
security number and birth date of a pupil from materials, including,
but not limited to, a written report indicating the grades received
by the pupil, that it mails to the residence of the pupil, or to any
one or more individuals authorized, as verified by the school of
attendance of the pupil, to receive those mailings, to do so.
Commencing July 1, 2008, a school district would be prohibited from
including the social security number or birth date of a pupil on
materials that it mails to the residence of the pupil or to any one
or more individuals authorized, as verified by the school of
attendance of the pupil, to receive those mailings. A school district
that chooses to, or is required to, change the software or other
technological means of managing the personal pupil
information, including, but not limited to, the social security
number and birth date of a pupil, would be required to ensure that
the new means of managing that information automatically omits the
social security number and birth date of a pupil from materials that
it mails to the residence of the pupil or to any one or more
individuals authorized, as verified by the school of attendance of
the pupil, to receive those mailings.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:
SECTION 1. Section 49079.5 is added to the Education Code, to
read:
49079.5. (a) (1) From January 1, 2008, to June 30, 2008,
inclusive, a school district that has the ability to omit the social
security number and birth date of a pupil from materials, including,
but not limited to, a written report indicating the grades received
by the pupil, that it mails to the residence of the pupil or to any
one or more individuals authorized, as verified by the school of
attendance of the pupil, to receive those mailings, is encouraged to
do so.
(2) Commencing July 1, 2008, a school district shall not include
the social security number or birth date of a pupil on materials,
including, but not limited to, a written report indicating the grades
received by the pupil, that it mails to the residence of the pupil
or to any one or more individuals authorized, as verified by the
school of attendance of the pupil, to receive those mailings.
(b) A school district that chooses to, or is required to, pursuant
to another statute, change the software or other technological means
of managing the personal pupil information,
including, but not limited to, the social security number and birth
date of a pupil, shall ensure that the new means of managing that
information automatically omits the social security number and birth
date of a pupil from materials, including, but not limited to, a
written report indicating the grades received by the pupil, that it
mails to the residence of the pupil or to any one or more individuals
authorized, as verified by the school of attendance of the pupil, to
receive those mailings.
