   An act to add Section  758.6   758.8  to
the Insurance Code, relating to insurance.


	LEGISLATIVE COUNSEL'S DIGEST


   SB 1167, as amended, Wiggins. Insurance: vehicle repair task
force.
   Existing law provides that no insurer shall require that an
automobile be repaired at a specific automotive repair dealer, as
defined.
   Existing law further provides that no insurer shall suggest or
recommend that an automobile be repaired at a specific automotive
repair dealer, except as specified.
   Existing law requires specified automobile insurers to provide
each insured with an Auto Body Repair Consumer Bill of Rights either
at the time of application for an automobile insurance policy or
following an accident that is reported to the insurer.
   This bill would require the Insurance Commissioner, within a
specified time period, to convene a task force, as specified, to
review the issues arising from the implementation of these
requirements and report its findings in writing to the Legislature by
December 31, 2009.
   Vote: majority. Appropriation: no. Fiscal committee: yes.
State-mandated local program: no.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  Section  758.6   758.8  is
added to the Insurance Code, to read:
    758.6.   758.8.   The commissioner
shall, within 30 days of the effective date of this section, convene
a task force, including, but not limited to, representatives of the
automobile insurance industry and consumer protection advocacy
organizations, to review the issues arising from the implementation
of Section 758.5 and report its findings in writing to the
Legislature by December 31, 2009.
