   An act to add Article 3 (commencing with Section 115810) to
Chapter 4 of Part 10 of Division 104 of the Health and Safety Code,
relating to synthetic turf.

   Existing law requires all new playgrounds open to the public built
by a public agency or any other entity to conform to the
playground-related standards set forth by the American Society for
Testing and Materials and the playground-related guidelines set forth
by the United States Consumer Product Safety Commission.
   This bill would prohibit a person from installing synthetic turf,
as defined, on an athletic playing field within the boundaries of a
public or private school or public recreational park unless and until
the Office of Environmental Health Hazard Assessment has prepared a
site specific environmental impact report on this installation. The
bill would also require, on or before June 30, 2009, the State
Department of Public Health to prepare and make available to the
public a health study on the use of crumb rubber within synthetic
turf.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  Article 3 (commencing with Section 115810) is added to
Chapter 4 of Part 10 of Division 104 of the Health and Safety Code,
to read:

      Article 3.  Synthetic Turf


   115810.  (a) No person shall install synthetic turf on an athletic
playing field within the boundaries of a public or private school or
public recreational park unless and until the Office of
Environmental Health Hazard Assessment has prepared a site specific
environmental impact report on this use or installation.
   (b) For purposes of this section, the following terms shall apply:

   (1) "Crumb rubber" means ground rubber derived from waste tires
and includes acetone, arsenic, cadmium, chromium, lead vanadium, or
zinc.
   (2) "Synthetic turf' means any composition material that includes
crumb rubber used to cover or surface an athletic field as an
alternative to grass.
  SEC. 2.  On or before June 30, 2009, the State Department of Public
Health shall prepare and make available to the public a health study
on the use of crumb rubber within synthetic turf.
