An act to add Chapter 4.8 (commencing with Section 18944.45) to
Part 2.5 of Division 13 of the Health and Safety Code, relating to
building standards.

Existing law sets forth various requirements for energy and design
efficiency in the construction and renovation of state buildings.
This bill would establish the Green Neighborhood Grant Act, to be
administered by the State Energy Resources Conservation and
Development Commission. Under the act, up to 3 grants would be
awarded annually to private developers for development projects that
have been certified by the Building Industry Institute as complying
with the California Green Builder Program. Each grant would reimburse
the developer for up to 1.5% of the total development cost of a
certified development project. No more than one grant would be
awarded annually to a developer for a development project located in
city with a population of greater than 1,000,000. Money for the
grants would be paid from the General Fund, upon an appropriation by
the Legislature.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:
SECTION 1. Chapter 4.8 (commencing with Section 18944.45) is added
to Part 2.5 of Division 13 of the Health and Safety Code, to read:
CHAPTER 4.8. GREEN NEIGHBORHOOD GRANT ACT
18944.45. (a) There is hereby established the Green Neighborhood
Grant Act.
(b) Commencing January 1, 2009, and every January 1 thereafter,
the State Energy Resources Conservation and Development Commission
shall issue a request for grant proposals from private developers for
development projects that have been certified by the Building
Industry Institute to comply with the California Green Builder
Program.
(c) The State Energy Resources Conservation and Development
Commission shall award annually up to three grants to private
developers who have submitted proposals pursuant to subdivision (a)
for certified development projects. Each grant shall reimburse the
private developer for up to 1.5 percent of the total development cost
of a certified development project. No more than one grant shall be
awarded annually to a private developer for a development project
located in a city with a population of greater than 1,000,000.
(d) Money for the grants shall be paid from the General Fund, upon
an appropriation by the Legislature for that purpose.
