(Coauthors: Assembly Members Carter and Cook)

                        FEBRUARY 21, 2008

An act to add Section 3003 to the Government Code, relating to
local government.

	LEGISLATIVE COUNSEL'S DIGEST

SB 1482, as introduced, Correa. Local government: forfeiture of
office.
Existing law sets forth the circumstances under which an office is
forfeited, including, among other things, upon the conviction of
certain crimes specified under the California Constitution or state
law.
Under the federal Stolen Valor Act of 2005, a person is guilty of
a crime, and may be imprisoned, fined, or both, if that person, among
other things, makes a false claim of receipt of any decoration or
medal authorized by Congress for the Armed Forces of the United
States or any of the service medals or badges awarded to the members
of those forces.
This bill would provide that an officer of a city, county, or
district in this state forfeits his or her office upon the conviction
of a crime pursuant to the federal act, that involves a false claim
of receipt of a military decoration or medal described in that act.
Vote: majority. Appropriation: no. Fiscal committee: no.
State-mandated local program: no.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

SECTION 1. Section 3003 is added to the Government Code, to read:
3003. An officer of a city, county, or district in this state
forfeits his or her office upon the conviction of a crime pursuant to
the federal Stolen Valor Act of 2005 (18 U.S.C. Sec. 704), that
involves a false claim of receipt of any military decoration or medal
described in that act.
