LEGISLATIVE COUNSEL'S DIGEST AB 1856, Jeffries. Elsinore Water District. The California Water District Law prescribes the powers and purposes of California water districts, which are local agencies. That law requires a California water district to hold regular meetings at times and places agreed to by resolution and authorizes those districts to hold special meetings in accordance with the Ralph M. Brown Act. The Ralph M. Brown Act generally requires the legislative body of a local agency to hold its meetings within the boundaries of the territory over which the local agency exercises jurisdiction. This bill would authorize the Board of Directors of the Elsinore Water District to conduct its meetings at the district office, or at any publicly owned location that is within the boundaries, or not more than one mile outside the boundaries, of the territory over which the district exercises jurisdiction. This bill would make certain findings and declarations regarding the inapplicability of a general statute within the meaning of Section 16 of Article IV of the California Constitution. This bill would declare that it is to take effect immediately as an urgency statute. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 34804 is added to the Water Code, to read: 34804. Notwithstanding Section 54954 of the Government Code, or any other provision of law, the Board of Directors of the Elsinore Water District may conduct its meetings at the district office, or at any publicly owned location that is within the boundaries, or not more than one mile outside the boundaries, of the territory over which the district exercises jurisdiction. SEC. 2. Due to the unique circumstances concerning the availability of adequate hearing facilities for Elsinore Water District, it is necessary that the district be authorized to hold hearings outside of the territory over which it exercises jurisdiction, and the Legislature finds and declares that a general statute cannot be made applicable within the meaning of Section 16 of Article IV of the California Constitution. SEC. 3. This act is an urgency statute necessary for the immediate preservation of the public peace, health, or safety within the meaning of Article IV of the Constitution and shall go into immediate effect. The facts constituting the necessity are: In order to ensure that the Elsinore Water District is able to hold its meetings in adequate and conveniently located facilities at the earliest possible time, it is necessary that the act take effect immediately.
