LEGISLATIVE COUNSEL'S DIGEST AB 2041, Fuentes. County employees' retirement: noncontributory plans: death of member. The County Employees Retirement Law of 1937 establishes noncontributory retirement plans for employees in specified counties. Under existing law, if approved by the county board of supervisors, members of those plans in the Counties of Los Angeles and Santa Barbara who have completed at least 5 years of credited service may elect to purchase retirement service credit. This bill would require, with respect to members of the noncontributory retirement plans in the Counties of Los Angeles and Santa Barbara, that, upon the death of an active or former member of the plan, the accumulated contributions made by the member, with interest, be paid to the member's beneficiaries. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 31486.36 is added to the Government Code, to read: 31486.36. Upon the death of an active or former member of the plan established by this article, an amount equal to the accumulated contributions made by the member pursuant to this article, with interest on that amount, shall be paid to the member's beneficiaries. SEC. 2. Section 31490.7 is added to the Government Code, to read: 31490.7. Upon the death of an active or former member of the plan established by this article, an amount equal to the accumulated contributions made by the member pursuant to this article, with interest on that amount, shall be paid to the member's beneficiaries.
