LEGISLATIVE COUNSEL'S DIGEST SB 1041, Committee on Veterans Affairs. State militia. Existing law provides that the militia of the state consist of the active militia, which includes the National Guard, the State Military Reserve, and the Naval Militia, and the unorganized militia, which includes all persons liable to service in the militia, except for members of the active militia. This bill would clarify that the unorganized militia does not include members of the State Military Reserve, in addition to the National Guard and the Naval Militia. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 121 of the Military and Veterans Code is amended to read: 121. The unorganized militia consists of all persons liable to service in the militia, but not members of the National Guard, the State Military Reserve, or the Naval Militia.
